These Terms of Service ("Terms") govern your access to and use of GardenPal's website, services, and mobile applications (collectively, the "Service"). Please read these Terms carefully before using the Service.
Acceptance of Terms
By using our Service, you agree to be bound by these Terms. If you don't agree to these Terms, you may not use the Service. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.
Description of Service
GardenPal provides a platform for users to track, plan, and learn about gardening. Our Service includes features such as plant identification, gardening tips, garden planning tools, and a community for sharing gardening experiences. We may update, modify, or enhance the Service at any time.
Your Account
To use certain features of the Service, you may need to create an account. You are responsible for maintaining the security of your account and password. GardenPal cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are also responsible for all content posted and activity that occurs under your account.
User Content
Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You retain ownership of any intellectual property rights that you hold in that User Content. By posting User Content, you grant GardenPal a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with providing the Service.
Rules of Conduct
You agree not to engage in any of the following prohibited activities:
- Violating any laws, regulations, or third-party rights
- Posting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity
- Interfering with or disrupting the Service or servers or networks connected to the Service
- Using automated means or processes to access or use the Service without our permission
Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of GardenPal and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GardenPal.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
Limitation of Liability
In no event shall GardenPal, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
